    Pharma industry seeks a pill for protection.
Suggests revision in patent act.


The Pharma sector has called for further alterations in the proposed bill to revive the Indian Patents Act, 1970. In a submission to the group of ministers examining the proposed bill the Indian Pharmaceutical alliance has said that act should provide greater clarity on patentablity and more safeguards against ‘evergreening’ to protect the interest of both the industry and the consumer.

Pointing on litigations pending in courts regarding exclusive market rights filed by foreign Pharma companies, IPA secretary general D G Shah said “these have clearly shown their intent to seek patents for new forms of know substances and file cases in courts to keep the generic out of the market.”

Example Novarirui is fighting a case for it anti- cancer drug, Glaxo Smith Kline has filed a case for its anti – diabetic drug etc.

“The bill should therefore clearly provide that patents intended to delay entry of generics, such as patents for polymorphs, isomers and metabolites, must not be permitted,” said shah in a newspaper interview.
